There is reason to be happy in Königs Wusterhausen and 35 other municipalities in Brandenburg: the new rent brake will take effect from January 1, 2026. This regulation aims to offer tenants better protection and secure affordable housing. The Brandenburg State Cabinet's regulation has been in effect since November 25, 2025 and is causing positive excitement among tenants. The new regulations mean that the local rent may be exceeded by a maximum of 10 percent for new contracts. For existing tenancies, the cap of a maximum of 15 percent rent increase within three years applies. This is what they are currently reporting Moz and BBU.
But in detail, the innovations are not without their pitfalls. Tenants in Königs Wusterhausen, a city with almost 40,000 inhabitants, do not have a rent index, which makes it much more complicated to determine the comparative rent. Loud Brandenburg Ministry of Infrastructure and State Planning Residents have to look for three comparable apartments or order an appraisal to determine the appropriate rent. For many tenants, this means additional effort and potentially high costs.

The Capping Limit Ordinance provides protection for existing tenants: they can defend themselves against excessive rent increases and do not simply have to accept rents that are too high. In order to be successful, it is important to “complain” about the rent in writing to the landlord. The tenants' association Dahme-Spreewald e.V. and apps like Conny are ready to offer legal support. Important to know: Fees for this support are only due if the case is successful, meaning that landlords are forced to pay the amount claimed back.
The Minister of Construction, Detlef Tabbert, hopes that the new regulations will result in a stable housing market and emphasizes the need to control rental prices. He makes it clear that the current rent control and capping limit regulations not only serve to secure tenants' rights, but also to respect the property rights of landlords. The state government is thus reacting to the results of a report that was commissioned in November 2024. This found that the previous regulations had a positive effect on rent development and were able to dampen rent prices.
Rents in view
A total of 36 communities in Brandenburg have been identified that will benefit from the new regulation, including Ahrensfelde, Bernau near Berlin, Falkensee and Teltow-Fläming. These regions are particularly tense when it comes to the housing situation. The state parliament also decided on this procedure in July 2025, showing that the state government is prepared to put more effort into improving the housing market. Its aim is to expand housing policy efforts, including the promotion of social housing.
The upcoming changes are a step in the right direction to counteract the increasing rental dynamics. The new regulations, which will come into force from January 2026, could also ensure a little more safety in Königs Wusterhausen.
